Consumer Sales
If you order goods other than as a consumer (e.g. because you are a business) then:
- these terms and conditions do not apply; and
- our business terms and conditions shall apply to your order and any resulting contract between you and us.
Terms of the Contract
- If you place an order for goods as a consumer, these terms and conditions apply to your order and to the contract between you and us.
- We may change these terms and conditions at any time. Any changes will apply to orders placed after we update the terms on our website; they will not apply to orders placed before the update.
When the Contract Is Created
- No contract exists between you and us until we notify you that we have accepted your order and delivered the goods;
- We are not obliged to accept your order;
- We may cancel your order if we cannot supply the goods for any reason.
a) Payment and Price
- We shall not be bound to deliver the goods until you have paid for them.
- Payment shall be due when the agreement is made between us.
- Time for payment shall be of the essence.
b) Delivery
- We will try to deliver the goods within the time estimated for delivery. Once we accept your order, we will endeavour to deliver within the chosen delivery period.
- If we cannot, we reserve the right to deliver within 30 days beginning with the day after the agreement.
- If still unable to deliver within that 30-day period:
- We shall inform you by e-mail, phone or message;
- We shall make a further offer by e-mail to sell goods of the same specification and at the same price, stating how long the offer remains valid;
- Unless you accept, we will reimburse any sum paid under the agreement within 30 days of the delivery period expiring.
c) Your Right of Cancellation
The rights of cancellation below apply to any agreement between you and us, except for unsealed computer software.
- You have a right to cancel at any time before the expiry of 14 calendar days beginning on the day the goods are delivered.
- You may cancel by notice in any of the following ways:
- In writing left at our address;
- In writing sent by post to our address;
- By e-mail to info@keironcheesbrough.com.
If You Cancel the Agreement
- You must return the goods complete to us at the address given.
- You are responsible for return costs and for taking reasonable care of the goods (including packaging and manuals) until they are returned.
- We may charge you for recovery costs if you fail to return the goods.
- No refund for extra express shipping services;
- We will reimburse by the original payment method within 14 days after you provide evidence of return and we have received the goods, including standard delivery costs (excluding extra delivery options).
- We may deduct for loss in value caused by unnecessary handling.
d) Our Right of Cancellation
If for reasons beyond our reasonable control (e.g. supplier failure) we cannot supply the goods, we may cancel any time before delivery by notice and promptly repay any sums paid. We shall not be liable for any further loss or damage.
e) Statutory Rights
- Your cancellation rights are in addition to your statutory rights.
- Our after-sales service and guarantees do not affect your statutory rights.
f) Guarantees and After-Sales Service
- We guarantee that the goods will correspond with their description and specification.
- We guarantee that the goods will be of satisfactory quality upon delivery by our carrier.
- Manufacturer’s guarantees and after-sales details will accompany the goods.
g) Advice Given by Us to You
- We can tell you the features of each product, but it is up to you to decide suitability.
- We do not provide guidance on suitability; this is your responsibility.
h) Your Responsibilities
- Ensure compatibility and proper installation of our goods.
- Pay any import charges, taxes or fees for deliveries outside the UK/EU.
- When returning goods, ensure proper & secure packaging and labelling; you remain liable for damage or loss in transit.
i) Images
Images on our website are for illustrative purposes only and may differ slightly from the actual goods.
j) Law
These terms and conditions and the contract are subject to English law.
